Rental Terms and Conditions

Section 1: Tourist Rentals

these terms and conditions apply to all Tourist (short-term) Rentals

1. Payment and Reimbursement

1.1 Rent is payable on the date of commencement of this contract.

1.2 Rent is payable in US dollars or VND at the current exchange rates set by Vietcom Bank.

1.3 The rent is not refundable.

1.4  Once any 24 hour period begins, rent for the full 24 hours is payable.

1.5 Party B (the renter) must inform Party A (Rentabike) of any problem with the bike as soon as possible and Party A will try to help. The cost of fixing the bike will be on Party B’s account if those problems are due to:

  • Party B has an accident.
  • Part B accidentally drops the bike resulting in broken parts or damage to the engine.
  • Party B doesn’t check the air in the tyres often enough, which causes flat tyres.
  • Party B gets the bike fixed somewhere without Party A’s knowledge or approval.
  • Any problem caused by misuse of the bike; i.e. driving in the water, overloading it etc.
  • Any problem due to the bike being dirty or not having been cleaned.
  • Flat tyres because of bad road conditions.

 

Please note that if Party B has paid to fix the bike without letting Party A know, Party A will not be responsible for any charge claimed.

1.6 The cost to fix the bike will be on Party A’s account if problems are due to:

  • Reasonable wear and tear on the bike caused by using the bike as it was intended.
  • Mechanical problems not resulting from accidents, incorrect use or unauthorised repairs of the bike.

 

Please note that if Party B has paid to fix the bike in any mechanic’s with Party A’s approval, Party A will reimburse those charges on Party A’s account as stated in 1.5 above in full and not be responsible for any incidental charges claimed.

1.7 Party A is not responsible for any services such as xe om, taxi or Grab bike for any reason.

2. Pickup and Return

2.1 The bike has to be picked up and returned at the Rentabike shop from which it was rented. Our shop locations are as follows:

  • Hanoi: 15a Ngo 12 Dang Thai Mai, Tay Ho, Hanoi
  • Da Nang: 4 An Thuong 16, Quan Ngu Hanh Son, Da Nang
  • Ho Chi Minh City: 86B Tran Phu, Phuong 4, Quan 5, HCMC

 

2.2 One-Way Rental fromBetween Hanoi, Da Nang and Ho Chi Minh City is available for a fee of 70 USD per bike.

2.3 All pickups and returns need to take place during working hours (8.30AM-5.30PM every day). If Party A is forced to collect any bike outside of these hours or from a third party, Party A reserves the right to withhold the deposit as stated in 5.2 below.

3. Service and Repair

3.1 If the keys are lost and Party B requires a new set of replacement keys, Party A will assist as soon as possible. The fee for a new set of keys is 100,000 VND plus any delivery charge incurred.

3.2 If the bike has any problem, Party B must take it to the nearest authorised mechanic to get it fixed. Party A can help take the bike to the shop if:

  • The bike is in the Hanoi area.
  • Party B can’t drive due to injury. However, a fee may be charged for transportation of the bike.

 

3.3 If Party B changes or fixes the bike without informing Party A beforehand or without Party A’s approval, Party A will not be responsible for any charge claimed.

4. Loss, Theft and Write-Off

4.1 In the event of lost, stolen and written-off bikes, Party A will:

  • Help report a missing bike to the police.
  • Estimate and inform Party B of the bike’s current value.
  • Request that Party B pay for the bike. Party A will then give Party B the bike’s registration papers so that Party B can claim the bike should the police find it.

 

4.2* If the police retrieve the bike, Party B must inform Party A as soon as possible so that Party A can help get it back. Party B will be responsible for any charges incurred which may include fines, storage or transportation fees.

4.3* If Party B parks the bike somewhere and loses the parking ticket, Party B must inform Party A as soon as possible and Party A will help get the bike back.

*Note: services 4.2 and 4.3 are only available if the bike is in Hanoi.

5. Deposit

5.1 The deposit is either Party B’s original, valid passport or 500 USD in cash.

5.2 The deposit will be returned if:

  • Party B returns the bike on time.
  • The bike is not damaged.
  • There are no missing parts.
  • The bike is reasonably clean.
  • The bike is returned with at least as much petrol as it had when Party B collected it.
  • The bike is reasonably clean.

 

5.3 The deposit will be returned in part or in full if:

  • The bike is damaged.
  • There are parts missing.
  • The bike is returned with less petrol than it had when it was rented.
  • The bike is dirty.
  • The bike is with a third party.
  • Party A is forced to collect the bike.

 

5.4 Party A will return the original deposit paid and will not allow for any difference in exchange rate, nor will Party A pay any interest on the original deposit.

5.5 Other charges:

  • Petrol fee: 100,000 VND
  • Bike cleaning fee: 50,000 VND

Section 2: Expat Rentals

these terms and conditions apply to all Expat (long-term) Rentals

1. Payment and Reimbursement

1.1 Rent is payable on the date of commencement of this contract.

1.2 Rent is payable in US dollars or VND at the current exchange rates set by Vietcom Bank.

1.3 Rent is to be paid one month in advance. If Party B (the renter) wishes to rent less than a full month, 24 hours’ advance notice is required. Monthly rentals are non-refundable: if Party B has paid for one month but wishes to return the bike early, the rent for the rest of the month will not be returned.

1.4 The rental fee for extra days is as follows:

  • Party B has an accident.

2. Delivery and Collection

2.1 The delivery/collection fee in 100,000 VND per bike per delivery/collection.

2.2 All deliveries/collections need to take place during working hours. If Party A is forced to collect any bike outside of these hours or from a third party, Party A reserves the right to withhold the deposit as stated in 6.2 below.

2.3 All pickups and returns need to take place during working hours (8.30AM-5.30PM every day). If Party A is forced to collect any bike outside of these hours or from a third party, Party A reserves the right to withhold the deposit as stated in 6.2 below.

2.3 Party A is unable to deliver/collect bikes outside Hanoi.

2.4 Bikes can be collected/returned to the shop from which they were rented at any time during working hours.

3. Service and Repair

3.1 Party A provides a free service once every to months, at the shop from which Party B rented the bike. Our shop locations are as follows:

  • Hanoi: 15a Ngo 12 Dang Thai Mai, Tay Ho, Hanoi (alternatively, we have a partner shop in the Old Quarter, at 31 Phu Doan)
  • Da Nang: 4 An Thuong 16, Quan Ngu Hanh Son, Da Nang
  • Ho Chi Minh City: 86B Tran Phu, Phuong 4, Quan 5, HCMC

 

3.2 If the keys are lost and Party B requires a new set of replacement keys, Party A will assist as soon as possible. The fee for a new set of keys is 100,000 VND plus any delivery charge incurred.

3.3 If the bike has any problem, Party B must take it to the nearest authorised mechanic to get it fixed. Party A can help take the bike to the shop if:

  • Party B can’t drive due to injury. However, a fee may be charged for transportation of the bike.
  • The bike will not start. However, if this is due to an accident a fee may be charged for transportation of the bike.

 

3.4 Flat tyres: Party A will reimburse the cost of fixing flat tyres if they are caused by the tyres being worn out. Party A will not reimburse the cost if they are caused by:

  • The air pressure in the tyres is incorrect.
  • The bike has carried more weight than it was supposed to.
  • The puncture is caused by factors out of Party A’s control; i.e Party B drove the bike over a sharp object such as a nail or a piece of broken glass.

Please note that if tyres are replaced or repaired without Party A’s approval, Party A will not be responsible for any charge claimed.

3.5 Party B must obtain prior approval for any and all mechanical work carried out on the bike, or be liable for both the cost of any work done and the cost of any proceeding work needed to fix any repairs.

4. Loss, Theft and Write-Off

*Note: services 4.2 and 4.3 are only available if the bike is in Hanoi.

5. Returning the Bike

5.1 The bike is to be returned to the shop from which it was rented, during working hours. A pickup fee will be charged if Party B is unable to return it. Our shop locations are as follows:

  • Hanoi: 15a Ngo 12 Dang Thai Mai, Tay Ho, Hanoi
  • Da Nang: 4 An Thuong 16, Quan Ngu Hanh Son, Da Nang
  • Ho Chi Minh City: 86B Tran Phu, Phuong 4, Quan 5, HCMC

 

5.2 24 hours’ notice is required prior to returning the bike, and Party A does not accept bikes being left with third parties.

5.3 If there is any damage to the bike Party A will withhold the deposit until repairs are done. Party B is expected to pay any extra costs if these are greater than the deposit.

5.4When returning the bike it is Party B’s responsibility to check carefully for any personal belongings left under the seat.

6. Deposit

6.1 The deposit is one month’s rent.

6.2 The deposit will be returned in full if:

  • Party B returns the bike on time with due notice.
  • The bike is not damaged.
  • There are no missing parts.
  • The bike is reasonably clean.
  • The bike is returned with at least as much petrol as it had when Party B collected it.
  • Party B has rented the bike for at least 2 months.

 

6.3 The deposit will be returned in part or in full if:

  • 24 hours’ notice of return was not given.
  • The bike is damaged.
  • There are parts missing.
  • The bike is returned with less petrol than it had when it was rented.
  • The bike is dirty.
  • The bike is with a third party.
  • Party A is forced to collect the bike or the bike is returned outside of working hours.
  • Party B did not rent the bike for at least two months.

 

6.4 Party A will return the original deposit paid and will not allow for any difference in exchange rate, nor will Party A pay any interest on the original deposit.

5.5 Other charges:

  • Petrol fee: 100,000 VND
  • Bike cleaning fee: 50,000 VND

7. Limitations

7.1 Party B must adhere to the mileage limit of 1,000 km per month.

7.2 Party A accepts no responsibility for any fines or criminal charges Party B might incur due to misuse of the bike.

7.3 Party A accepts no responsibility for any physical injury Party B might suffer.

7.4 Party B must accept to use the bike legally within the confines of Vietnamese law, and accept full responsibility for any loss, theft, damages, fines and physical injury.

7.5 Party A reserves the right to rescind the contract and take control of the bike at any time.
